1. Introduction

This Agreement outlines the Terms & Conditions for services and/or digital products provided by Tori Lutz (hereinafter “the Provider”) to you, the Client (hereinafter “the Client”). Its purpose is to define the scope of services, sales, and mutual expectations in a transparent and professional manner. By purchasing or using the Provider’s services or digital products, the Client acknowledges and agrees to these Terms & Conditions.

2. Cancellation & Refund Policy (1:1 Services)

Individual Sessions

Refunds are available for cancellations made up to 7 days before the scheduled session.
Sessions cancelled within 7 days of the scheduled date are non-refundable.
Rescheduling is allowed if requested at least 48 hours before the scheduled session.
No-shows (failure to attend without notice) are non-refundable, and the Client is responsible for the full session fee.

Prepaid Packages / Multi-Session Services

All prepaid packages are non-refundable.
Packages must be used within the valid timeframe stated at the time of purchase.
Rescheduling of individual sessions within a package is allowed in line with the rules for individual sessions (48 hours’ notice).
No-shows for individual sessions within a package are treated as missed sessions with no refund.

Provider Cancellations

If the Provider must cancel or reschedule due to unforeseen circumstances (e.g., emergency, illness, or technical issue), the Client will be notified promptly.
The Client may choose to reschedule or receive a full refund for any pre-paid fees.

3. Cancellation & Refund Policy for Events or Group Services

Client Cancellations & Rescheduling

Clients must provide at least 48 hours’ notice to cancel or reschedule participation in an event, course, or group service.
Cancellations made within 48 hours of the event are non-refundable.
No-shows (failure to attend without notice) are non-refundable, and the Client is responsible for the full fee.

Provider Cancellations

If the Provider must cancel or reschedule an event or group session due to unforeseen circumstances (e.g., emergency, illness, or technical issue), Clients will be notified promptly.
Clients may choose to reschedule or receive a full refund for any pre-paid fees.

4. Confidentiality

The Provider is committed to maintaining the confidentiality of all Client information. Any personal or business details shared will remain confidential and will not be disclosed to third parties without the Client’s consent, except where required by law.

All client records and data are stored securely in compliance with applicable data protection and privacy laws (e.g., UK & EU GDPR).
The Client also agrees not to disclose confidential information about the Provider or other clients. Both parties acknowledge that confidentiality is essential to maintaining trust in their professional relationship.

5. Liability Disclaimer

Results Not Guaranteed

The Provider offers professional services and digital products in good faith but does not guarantee specific outcomes. Results depend on the Client’s individual use, implementation, and circumstances.

Limitation of Liability

To the fullest extent permitted by law, the Provider shall not be liable for any indirect, incidental, or consequential damages arising from the use of services or digital products. The Client agrees that the Provider’s total liability shall not exceed the amount the Client has paid for the product or service in question.

Client Responsibility

The Client acknowledges they are solely responsible for their decisions, actions, and use of the Provider’s services or products. The Provider is not responsible for outcomes that differ from the Client’s expectations, except in cases of gross negligence or willful misconduct.

6. Client Responsibilities

Clients agree to:

Provide accurate information – Share relevant personal, health, or background information needed for the safe and effective delivery of services.
Be punctual – Arrive on time for sessions and communicate any scheduling changes promptly.
Respect the session space – Maintain respectful communication and uphold professionalism during sessions.
Follow applicable laws – Comply with all relevant laws and intellectual property rights.
Engage in the process – Participate fully and provide feedback where appropriate to help improve the effectiveness of services.
Understand personal responsibility – Recognise that the Provider’s services support guidance and tools, but outcomes depend on the Client’s engagement and application.

Important notes for Spinal Energetics:

Clients must disclose relevant medical conditions or injuries before the session.
Sessions are not a substitute for medical advice or treatment, and the Provider is not liable for medical outcomes.
By booking a session, the Client confirms that they have read and understood any contraindications provided and acknowledges that it is their responsibility to ensure the service is suitable for them.

Repeated non-compliance with these responsibilities may result in suspension or termination of services.

7. Amendments & Governing Law

Amendments to Terms

The Provider may update these Terms & Conditions to reflect changes in laws, services, or business policies. Any updates will be communicated in writing or posted on the Provider’s website. Continued use of the services or products constitutes acceptance of revised Terms.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the United Kingdom. Any disputes shall fall under the jurisdiction of the courts of the United Kingdom, unless otherwise agreed.

Dispute Resolution

Both parties agree to attempt to resolve disputes amicably through direct communication or mediation before pursuing legal action.

Acceptance

By purchasing or using the Provider’s services or digital products, the Client acknowledges that they have read, understood, and agree to these Terms & Conditions. Both parties may retain a copy of this Agreement for their records.
