Fluum Terms of Service

These Terms of Service ("Terms") govern your access to and use of Fluum, an artificial intelligence (“AI”) powered professional networking and introduction platform. By using Fluum, you agree to be bound by these Terms.
1. Definitions
"Company," "we," "our," or "us" refers to ZENPASS LTD, a company registered in England and Wales (Company No. 15193625), trading under the name Fluum.
"Service" or "Platform" refers to the Fluum website (https://fluum.ai), mobile applications, and all related tools, features, and functionalities provided by Fluum, including AI-powered matching and introduction facilitation.
"User" or "you" refers to any individual or organisation that creates an account and uses the Fluum Platform.
"Match" refers to an AI-generated potential connection between two users or between a user and a Matched Contact, based on professional signals, network context, and compatibility analysis.
"Matched Contact" refers to any individual identified by Fluum's AI as a potential connection for a User, regardless of whether that individual is a registered User of Fluum . Matched Contacts may include professionals sourced from publicly available data, third-party data providers, or Partner networks.
"Introduction" refers to a facilitated warm connection between two Users or a user and a Matched Contact who have expressed interest in connecting.
"Signals" refers to professional data points used by our AI to generate Matches, including but not limited to: publicly available professional information, LinkedIn activity, job changes, company news, network connections, and User-provided preferences.
"Introduction Request" refers to a User-initiated request to be connected with a specific Match.
"Profile Information" refers to professional information about a User, including data from public social media profiles, that is used to facilitate Matches and Introductions.
"Partner" refers to organisations that agree to work with Fluum to provide services within their network, including communities, accelerators, enterprise clients, and other entities that may share opted-in users with Fluum's network.
"Personal Data" refers to any information relating to an identified or identifiable natural person, as defined by the General Data Protection Regulation (GDPR).
2. Eligibility
You must be at least 18 years of age to use the Service. By using Fluum, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using Fluum on behalf of a business or organisation, you represent that you have authority to bind that entity to these Terms.
3. Account Terms
- You are responsible for safeguarding your account credentials. We are not liable for losses due to stolen or misused accounts.
- You are responsible for all activity that occurs under your account.
- Account creation via bots or automation is not permitted.
- You must provide accurate and complete information when creating your account and keep this information up to date.
- By creating an account, you consent to receive essential service updates and promotional communications. You may opt out of promotional communications at any time.
4. How Fluum Works
Fluum is an AI-powered superconnector platform that facilitates warm introductions between professionals. Our Service operates as follows:
4.1 AI Matching
Our proprietary AI analyses professional Signals to identify potential Matches between Users or Matched Contacts. These Signals include publicly available professional information, network context, User-provided preferences, and professional activity patterns.
4.2 Introduction Facilitation
When Users express interest in connecting, Fluum facilitates warm Introductions. Contact information is only shared between Users and their Matches after appropriate consent has been obtained.
4.3 Network Participation
By joining Fluum, you agree to be included in our matching pool and to have your Profile Information visible to potential Matches. You retain the right to decline any Introduction Request.
5. Service Operation and Matching
By using the Service, you understand and agree that:
- Your Profile Information will be visible to potential Matches within the Fluum network.
- You will be added to Fluum's matching pool upon account activation.
- Potential Matches may view your Profile Information before deciding whether to connect.
- Your contact information (email address and/or phone number) will only be shared with another User after appropriate consent mechanisms have been satisfied.
- You may decline any Introduction Request.
6. User Conduct
Users are expected to maintain professional and respectful behaviour when interacting with other Users within the Fluum network and Matched Contacts involved in the Matches. Fluum aims to provide a positive environment for meaningful professional connections.
Inappropriate conduct includes, but is not limited to:
- Using offensive, discriminatory, or inflammatory language.
- Engaging in hostile, aggressive, or unprofessional communication.
- Making inappropriate personal remarks or threats.
- Deliberately misusing or attempting to exploit the AI matching system.
- Any form of harassment, spam, or unsolicited commercial messaging.
- Misrepresenting your identity, qualifications, or professional background.
- Using Introductions for purposes other than legitimate professional networking.
Violation of these conduct guidelines may result in restriction, suspension, or permanent removal from the Fluum network, at Fluum's sole discretion.
7. Use of AI and Data
Fluum uses artificial intelligence to process and analyse:
- Publicly available professional signals (e.g., social media activity, job changes, company related news).
- Public professional information (company, job title, industry, expertise).
- Network context and connection patterns.
- User-provided information (preferences, ideal client profiles, expertise areas).
- Interaction data within the Platform.
7.1 Third-Party AI Processing
To provide our Services, Fluum uses third-party AI providers, including OpenAI, Anthropic, and other AI technology providers. By using the Service, you acknowledge and agree that your data may be processed by these services. Information processed may include:
- Profile Information and professional data.
- User preferences and matching criteria.
- Interaction data within the Platform.
These third-party providers process data according to their own privacy policies and security standards, and are bound by industry-standard confidentiality and security requirements. We select providers based on their security practices and regularly review their compliance with applicable data protection standards.
7.2 Lead Data and Enrichment
Fluum may use third-party data providers to enrich Profile Information with publicly available professional data. This enrichment helps improve Match quality and relevance. Such data may include:
- Publicly available intent signals (e.g., professional interactions, event registrations, job changes).
- Public professional information (company, job title, industry, URLs).
- Professional network data from third-party providers.
You are responsible for complying with relevant regulations (e.g., GDPR, CCPA) when acting upon Introductions or Match data provided by Fluum.
7.3 No Guarantees
We do not guarantee the accuracy, completeness, or timeliness of Match data, enriched data, or AI-generated insights. You are solely responsible for verifying information and making your own decisions regarding Introductions and potential business relationships.
Fluum does not guarantee that Matches will result in meetings, business relationships, contracts, revenue, or any particular outcomes. Historical response rates are provided for informational purposes only and do not constitute a promise of future performance.
8. Third-Party Platforms
Our Services may interact with or depend on third-party platforms, including professional networks such as LinkedIn and communication tools.
You acknowledge that:
- Fluum is not affiliated with, endorsed by, or officially connected to LinkedIn, Instagram or any other third-party platform.
- Your use of such platforms remains subject to their own terms and policies.
- You are solely responsible for ensuring that your activity through Fluum complies with the terms of service of any third-party platforms.
- Fluum shall not be held liable for any restriction, suspension, or termination of your accounts on third-party platforms, or for any changes made by such platforms that may affect the operation of our Services.
- Integrations with third-party platforms may be modified, suspended, or discontinued at any time, without prior notice.
9. Marketing Communications
By providing your email address and phone number when creating an account, you consent to receive marketing communications from Fluum. These communications may include:
- Updates about new features and platform improvements.
- Information about events, webinars, or networking opportunities.
- Partnership opportunities and personalized recommendations.
- Newsletters and content related to professional networking.
9.1 Opting Out
You may opt out of marketing communications at any time by:
- Using the unsubscribe link included in marketing emails.
- Replying STOP to SMS text messages.
- Adjusting your communication preferences in your account settings.
- Contacting us at contact@fluum.ai.
Please note that opting out of marketing communications does not affect the receipt of essential account-related notifications, service updates, or other legally required communications.
9.2 Newsletter Enrolment
By signing up for the Service, you may also be enrolled in Fluum's newsletter and related content. You may unsubscribe from these at any time using the methods described above.
10. Digital Advertising and Data Usage
By using Fluum's Services, you acknowledge and consent to the following data usage practices:
10.1 Social Media Advertising
Fluum may use your contact information (email addresses and phone numbers) in hashed or encrypted formats to create custom audiences on social media platforms, including Meta (Facebook/Instagram), LinkedIn, and other advertising platforms, for targeted advertising and retargeting purposes.
10.2 Conversion Tracking
We use tracking technologies, including pixels and similar tools, to measure the effectiveness of our advertising campaigns and understand user behaviour across platforms.
10.3 Lookalike Audiences
Your Profile Information may be used to help create audiences of users with similar characteristics for advertising and user acquisition purposes.
10.4 Cross-Platform Tracking
Information about your interactions with Fluum may be shared with advertising platforms to deliver relevant advertisements to you on social media and other websites.
10.5 Opting Out
You may opt out of targeted advertising by:
- Adjusting your preferences on the respective social media platforms.
- Using browser-based opt-out tools.
- Contacting us at contact@fluum.ai.
11. Partner Network
Fluum collaborates with Partner organisations to expand the introduction pool and provide enhanced services. These Partners may include professional communities, accelerators, enterprise clients, and other organisations.
11.1 Partner Network Participation
Users who opt in through Partner networks agree to have their profiles included in both the Partner network and Fluum's global network for potential Introductions.
11.2 Partner Data Sharing
If you join Fluum through a Partner organisation, the following may apply:
- Your Profile Information may be shared with the Partner organisation for the purposes of facilitating Introductions within their network.
- You may receive Matches from both the Partner network and Fluum's broader network.
- The Partner organisation may have access to aggregated or anonymised usage data related to their network.
11.3 Enterprise and B2B Partners
For enterprise or B2B partnerships, additional terms may apply as specified in separate agreements between Fluum and the Partner organisation. Users participating in such programs will be notified of any additional terms that apply to them.
12. Payments, Billing, and Free Trial
12.1 Free Trial
Fluum may offer a free trial period for new Users. During the free trial, you will have access to the Platform's features as specified at the time of sign-up.
Trial Expiry Notification: You will receive a notification at least 3 (three) days before the expiry of your free trial period. This notification will inform you that your trial is ending and that your subscription will automatically commence unless you cancel before the trial ends.
If you do not cancel before the trial period ends, your paid subscription will automatically begin and your designated payment method will be charged.
12.2 Subscription Fees
If you subscribe to a paid plan, you authorise us to charge your payment method immediately upon the commencement of your paid subscription (following any free trial period) and on a recurring basis thereafter (monthly or annually, as selected).
You must provide accurate billing information, including your full name, address, VAT number (if applicable), and a valid payment method.
All fees are exclusive of applicable taxes unless otherwise stated.
12.3 Non-Refundable Payments
All subscription payments are non-refundable. Given that a free trial period is provided to allow you to evaluate the Service before committing to a paid subscription, no refunds will be issued for subscription fees once payment has been processed, except where required by applicable law.
13. Cancellation and Termination
- You may cancel your subscription at any time through your account settings. Your subscription will remain active until the end of the current billing cycle.
- We reserve the right to suspend or terminate accounts for any reason, including abuse, violation of these Terms, or conduct that we determine to be harmful to other Users or the integrity of the Platform.
- Upon termination, you will lose access to the Service and any stored content or data associated with your account.
14. Privacy and Data Protection
Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which forms part of these Terms.
14.1 GDPR Compliance
If you are located in the European Economic Area (EEA) or United Kingdom, you have certain rights under the General Data Protection Regulation (GDPR), including the right to access, rectify, erase, restrict processing of, and port your personal data. 14.2 Data Controller
ZENPASS LTD (trading as Fluum) acts as the data controller for personal data processed through the Platform.
14.3 Your Responsibilities
You are responsible for complying with all applicable data protection regulations (including GDPR and CCPA where applicable) when acting upon Introductions facilitated by Fluum.
15. Internal Data Access and Usage
The Fluum team has access to and may monitor:
- User interactions with the Platform.
- Profile Information and Match data.
- Communication metadata (not content of external communications).
- User behavioural data and platform usage patterns.
15.1 Purpose of Access
This access is strictly for the purposes of:
- Monitoring and preventing platform abuse.
- Improving the product experience and Match quality.
- Resolving user issues and providing support.
- Ensuring service quality and safety.
- Complying with legal obligations.
15.2 Data Handling Protocols
While Fluum team members can access individual user data for the above purposes, we maintain strict data handling protocols:
- Specific user information is never exported or used for purposes other than those listed above.
- User data is only accessed when necessary for service operation and improvement.
- Anonymous and aggregated data may be used for product analytics and service enhancement.
- All team members are bound by confidentiality requirements regarding user data.
16. Data Security and Backup
16.1 Security Measures
We implement industry-standard security measures to protect your data, including:
- Encryption of data in transit and at rest.
- Regular security assessments and monitoring.
- Access controls and authentication requirements.
- Secure infrastructure and hosting.
16.2 Data Backup
Fluum maintains regular backups of user data to ensure service continuity and data protection. These backups are:
- Encrypted and stored securely.
- Subject to the same access controls as primary data.
- Retained in accordance with our data retention policies.
16.3 No Absolute Guarantee
While we strive to protect your data, no method of transmission over the Internet or electronic storage is 100% secure. We cannot guarantee absolute security of your data.
17. Data Retention
We retain personal data for the following periods:
17.1 Active Account Data
- Profile and matching data: Retained while your account is active and for 2 (two) years after account deletion to comply with legal obligations and resolve any disputes.
- Communication records: Retained for 3 (three) years for service improvement, support, and legal compliance.
- Transaction and billing data: Retained for 7 (seven) years as required by financial regulations.
17.2 Marketing Data
- Marketing preferences and consent records: Retained until you opt out, then deleted within 30 days.
- Advertising audience data: Retained in accordance with third-party platform policies.
17.3 Legal Compliance Data
- Data required for legal compliance is retained as mandated by applicable law.
17.4 Data Deletion Requests
You may request deletion of your personal data by contacting privacy@fluum.ai. Please note that some data may be retained as required by law or for legitimate business purposes as described above.
18. Acceptable Use
You agree not to:
- Use the Services for any unlawful or abusive purpose.
- Violate the rights of any third party (e.g., through spam, scraping, or unauthorised access).
- Interfere with the proper functioning of our Platform or attempt to circumvent its limitations.
- Use the Services in a way that violates applicable data protection laws or marketing regulations.
- Use Introductions to send unsolicited bulk communications or spam.
- Attempt to reverse engineer, decompile, or extract the source code of our AI matching algorithms.
- Create multiple accounts to circumvent restrictions or manipulate the matching system.
19. Intellectual Property
The Service and its original content, features, AI algorithms, and functionality are and will remain the exclusive property of ZENPASS LTD (Trading as Fluum AI) and its licensors. The Fluum name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of ZENPASS LTD.
You agree not to copy, modify, distribute, sell, or lease any part of our Services or included software, nor may you reverse engineer or attempt to extract the source code of that software.
20. Limitation of Liability
Fluum is not liable for any outcomes resulting from Introductions or interactions facilitated by the Service. Users agree that the connections facilitated by Fluum are provided on an "as-is" basis, and Fluum does not guarantee success, meetings, business relationships, contracts, revenue, or any particular results from the use of the Service.
To the maximum extent permitted by law, Fluum shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of business opportunities, or business interruption, arising from your use of the Services.
Fluum shall not be liable for any adverse action, suspension, or limitation imposed by third-party platforms (including LinkedIn) as a result of your use of our Services.
Our total liability to you for any claims arising out of or related to these Terms or the Service shall not exceed the greater of: (a) the fees you paid to Fluum in the 12-month period preceding the claim, or (b) £100.
21. Disclaimers
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
Fluum does not warrant that:
- The Service will function uninterrupted, be secure, or be available at any particular time or location.
- Any errors or defects will be corrected.
- The results obtained from the use of the Service will be accurate, reliable, or meet your expectations.
- Any Matches or Introductions will result in business outcomes.
- The quality of any Matches will meet your specific requirements.
- Third-party enrichment data will be accurate or complete.
22. Indemnification
You agree to indemnify, defend, and hold harmless ZENPASS LTD (trading as Fluum), its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, losses, damages, obligations, costs, actions, or demands arising from:
- Your use of the Service.
- Your breach of any of these Terms.
- Your violation of any rights of another party, including other Users.
- Any content you provide or actions you take following an Introduction.
- Your violation of applicable laws or third-party platform terms of service.
23. Modifications
We may update these Terms from time to time to reflect changes to our practices, Services, or for legal, operational, or regulatory reasons.
Material changes will be communicated to Users via email or platform notifications at least 30 days before they take effect.
Your continued use of the Service after changes have been communicated will constitute acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and cancel your subscription.
24. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.
Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where GDPR or other applicable data protection laws provide for alternative jurisdiction.
25. Feedback
We welcome your feedback and suggestions for improving Fluum. By providing feedback, you grant Fluum a worldwide, royalty-free, perpetual, irrevocable licence to use, modify, and incorporate your feedback into our Services without restriction or compensation to you.
